Terms and conditions of sale

1. Seller and scope
These terms govern sales of e-liquids and vaping flavourings and the products presented on the Maître Vapotier website by MAITREVAPOTIER, SAS, SIREN 105 094 015, whose registered office is at 47 rue Vivienne, 75002 Paris, France, hereinafter the “Seller”. Full company information is provided in the legal notice.
The shop is intended exclusively for professionals purchasing for the purposes of their business. The customer declares that they have authority to bind the company they represent and that the information they provide is accurate. Special terms expressly agreed in writing take precedence over any incompatible provisions of these terms. Any applicable mandatory provisions remain unaffected.
2. Trade account
Creating an account does not automatically confer the right to order. The Seller reviews the application and may request relevant information to confirm the company’s existence and the applicant’s connection to it.
A SIREN search prefills publicly available information for French companies. Companies outside France enter their identifiers and contact details. Unavailability of the register does not constitute rejection of the application. The customer must keep their information up to date and protect the confidentiality of their access credentials.
3. Products and information
The available product references, their characteristics, packaging and conditions of use are specified in their product pages and applicable documents before the order is placed. Graphic representations of flavours illustrate the world of the creations; they are neither an ingredient list nor a dosage indication.
The customer selects products suited to their activity and complies with the instructions on use, storage and traceability supplied with the products. Placing an order does not authorise any use contrary to that information.
4. Prices and tax
Trade prices are expressed in euros excluding tax. The applicable price and any discounts granted to the customer are those displayed or agreed when the order is confirmed. Transport charges and applicable taxes are shown before final confirmation.
Delivery outside France does not automatically qualify for VAT exemption. Intra-Community supplies are invoiced without French VAT only where the legal conditions are met, including the validity of the VAT number provided and actual transport to another Member State. Exports outside the EU’s tax territory follow a separate regime. Additional checks or a specific offer may be necessary.
The customer provides accurate tax identifiers and reports any changes. Any duties, import taxes and formalities for which the customer may be responsible must be specified in the applicable offer before acceptance; no particular customs arrangement is presumed.
5. Orders
The customer selects their products, checks quantities, addresses, charges and the total, reads these terms and confirms the order. The confirmation displayed and subsequently sent or made available in their account summarises the details of the sale.
The Seller may request correction of contact or address details, or a verification, before confirming an order. If unavailability or an inability to fulfil the order is identified after payment, the Seller informs the customer and agrees an appropriate solution with them; amounts relating to unfulfilled obligations are refunded where no alternative solution is accepted.
6. Payment in full at the time of order
Payment is due in full when ordering, by bank transfer. Bank details and the payment reference are supplied when the order is placed. Preparation begins once receipt of payment is confirmed. Creating an account does not grant a credit term.
Unless specifically agreed in writing, no early-payment discount is offered. Any amount due that remains unpaid on its due date incurs the penalties provided for in Article L.441-10 of the Code de commerce, at the European Central Bank refinancing rate applicable to the relevant half-year plus ten percentage points, without falling below the statutory minimum. The fixed recovery charge of 40 euros is payable under the conditions laid down by law; additional compensation may be claimed with supporting evidence where the costs incurred exceed this amount.
7. Territory and dispatch
Delivery and billing addresses must be in the 25 countries served. Territories outside these areas are not served, even where they are associated with a Member State. Carrier availability and any specific arrangements are checked during the ordering process.
For standard orders, subject to available stock: Orders are dispatched within 48 hours of payment confirmation and validation of the information needed to fulfil them. This period refers to handover to the carrier; it is not a guarantee of delivery within 48 hours. Any exception relating to a product must be brought to the customer’s attention before the order is placed.
From 500 units of the same product, the order enters made-to-order production and the label language can be selected. This option remains available even without stock; below 500 units, orders are limited to available stock. Allow one month before delivery. When an order combines standard products and made-to-order production, all products are shipped together after production.
Transit time and cost are those presented when ordering or in the accepted offer. An incomplete or incorrect address may require correction and result in justified redelivery charges, which will be communicated to the customer.
8. Receipt and complaints
On receipt, the customer checks the parcels and products and reports any anomalies as soon as possible, supplying the information needed to assess them: order reference, affected products, photographs and batch number where shown on the packaging. Statutory transport formalities and time limits remain applicable.
The customer service contact is contact@maitrevapotier.com. Any authorised return address is provided by the Seller; no unsolicited return shipment should be made.
9. Returns
Returns for convenience, changes of mind or customer selection errors are not accepted. The website does not offer a commercial “satisfaction or your money back” guarantee.
This rule does not remove applicable remedies for defects, non-conformity or hidden defects, nor mandatory rights that may apply to a particular situation. A substantiated complaint is assessed separately and may result, depending on the circumstances and applicable rules, in replacement, repair where relevant, a price reduction or a refund.
10. Liability and force majeure
Each party is responsible for its own obligations. These terms do not exclude liability that cannot legally be limited. A party prevented from performing by an event meeting the legal conditions for force majeure informs the other party and takes reasonable measures to limit its consequences.
11. Data and evidence
The privacy policy supplements these terms in relation to data processing. Retained order information, confirmations and documents may be used to establish the transactions carried out, subject to the applicable rules of evidence.
12. Governing law and disputes
The parties first seek an amicable solution by contacting customer service. These terms are governed by French law, subject to the rules and conventions applicable to international sales and to mandatory provisions. If no agreement is reached, the dispute falls within the jurisdiction of the courts competent under the applicable rules. No unspecified exclusive jurisdiction is presumed.
Consumer mediation does not apply to disputes between professionals. This provision does not prevent the parties from agreeing to commercial mediation.
